HeyLabs AI Terms of Use

Section 1: Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of HeyLabsAI.com, HeyKids.ai, and HeySchool.ai (collectively, the "Service"), operated by HeyLabs, Inc. ("HeyLabs," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations.

If you are a parent or legal guardian agreeing to these Terms on behalf of a child under the age of 13, you accept full responsibility for that child's use of the Service and agree to supervise their activity accordingly.

If you do not agree to these Terms, you must not access or use the Service.

Section 2: Description of Service

HeyLabs AI operates an educational artificial intelligence platform designed for K-12 learners, parents, and educators. The Service includes the following products:

  • HeyKids: An age-appropriate AI learning coach that personalizes to each student's educational journey
  • HeySchool: A classroom AI platform with automated lessons, grading, and real-time insights

The Service is intended for educational purposes only and does not replace professional instruction, tutoring, or counseling.

HeyLabs reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Section 3: Eligibility and Age Requirements

Access to the Service requires the ability to form a legally binding contract or, for minors, the consent of a parent or legal guardian.

Children Under 13

In compliance with the Children's Online Privacy Protection Act (COPPA):

  • Birth month and year are collected during registration for age verification purposes
  • Parental consent is requested via email upon registration of a child under 13
  • If parental consent is not obtained within 7 days, the child's account is deactivated and all associated data is permanently deleted

Users Aged 13–17

Users between the ages of 13 and 17 may create accounts independently. By doing so, they represent that a parent or legal guardian has reviewed and consented to these Terms and their use of the Service.

EU Users

In accordance with the General Data Protection Regulation (GDPR), children under 16 years of age in the European Union require parental or guardian consent to use the Service.

Section 4: Account Registration and Security

You agree to provide accurate, current, and complete information during the registration process and to keep such information up to date. You are responsible for maintaining the confidentiality of your account credentials.

Account Types

  • Student accounts: Subject to age screening and applicable parental consent requirements
  • Parent accounts: Enable management of linked student accounts and oversight of student activity
  • Teacher accounts: Provide classroom management tools and require parental approval before accessing student data

You are responsible for all activity that occurs under your account. If you become aware of any unauthorized access to or use of your account, you must notify us immediately at [email protected].

Section 5: Acceptable Use

You agree to use the Service only for lawful educational purposes. The following activities are strictly prohibited:

  • Using the Service for any illegal purpose or in violation of any applicable law or regulation
  • Attempting to gain unauthorized access to any part of the Service, other accounts, or computer systems
  • Interfering with or disrupting the Service, servers, or networks connected to the Service
  • Transmitting any malware, viruses, or other harmful code
  • Engaging in harassment, bullying, or any conduct that is harmful to other users
  • Using automated systems, bots, or scripts to access the Service without our prior written consent
  • Reverse-engineering, decompiling, or disassembling any portion of the Service
  • Collecting or harvesting any user data without authorization
  • Taking any action that imposes an unreasonable load on the Service infrastructure

Violations of this policy may result in immediate suspension or termination of your access to the Service.

Section 6: Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, video, software, and underlying code — are the property of HeyLabs or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the Service, without prior written permission from HeyLabs.

User Content

By submitting content to the Service (including but not limited to text, responses, and educational materials), you grant HeyLabs a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content for the purposes of providing, maintaining, and improving the Service. You retain ownership of any content you submit.

Section 7: AI-Generated Content

The Service uses artificial intelligence to generate educational content and responses. You acknowledge and agree that:

  • AI-generated content is provided for educational and informational purposes only and does not constitute professional advice of any kind
  • AI-generated responses may contain inaccuracies, errors, or incomplete information
  • HeyLabs implements safety guardrails designed to ensure content is appropriate for children, but no system is infallible
  • AI-generated content is not a substitute for professional instruction, tutoring, counseling, or medical advice

Users should exercise their own judgment when relying on AI-generated content and should consult qualified professionals for specific concerns.

Section 8: Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to:

  • The collection of limited personal information as described in the Privacy Policy
  • COPPA-compliant procedures for users under 13 years of age
  • Data minimization practices that limit collection to information necessary for the Service
  • Your rights to access, correct, and delete your personal information as set forth in the Privacy Policy

Section 10: Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEYLABS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy, reliability, or completeness of any content provided through the Service

Your use of the Service is at your sole risk.

Section 11: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEYLABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

In no event shall the total liability of HeyLabs to you for all claims arising from or related to the Service exceed the greater of (a) the amounts you have paid to HeyLabs within the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100 USD).

Section 12: Indemnification

You agree to indemnify, defend, and hold harmless HeyLabs, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of or access to the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you submit to or through the Service

Section 13: Termination

You may discontinue your use of the Service and delete your account at any time. HeyLabs may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or any applicable law
  • Conduct that is harmful to other users, HeyLabs, or third parties
  • Safety concerns, particularly regarding minor users
  • Compliance with legal requirements or law enforcement requests

Upon termination, your right to use the Service will cease immediately. Personal data will be deleted in accordance with our Privacy Policy. Any provisions of these Terms that by their nature should survive termination shall remain in effect.

Section 14: Changes to These Terms

HeyLabs reserves the right to modify these Terms at any time. When material changes are made, we will notify users and parents of registered children through email notification, dashboard alerts, or other reasonable means prior to the changes taking effect.

The "Last Updated" date at the top of this page indicates when these Terms were most recently revised. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.

Section 15: Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved through informal negotiation shall be submitted to final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its rules. The arbitration shall take place in Wilmington, Delaware.

Class Action Waiver

All disputes shall be conducted on an individual basis only. You agree to waive any right to participate in a class action, collective action, or representative proceeding against HeyLabs.
